This chapter was an effort to help seasoned Elder Law attorneys and those less experienced attorneys to be cognizant of the pertinent legal definitions of capacity, the applicable burdens of proofs, suggestions as to approaching litigation involving the elderly, and identifying the unconventional definitions of success.
