A contested guardianship or conservatorship is distinct from other areas of civil litigation, particularly in the complexity and involvement of familial relationships. Practitioners should approach a contested guardianship or conservatorship in a far different manner than other areas of litigation. Family dynamics can cloud a client’s goals and objectives and, without proper guidance from their attorney, can result in a proceeding being unnecessarily delayed, prolonged, and damaging.
